​If you are confident that you would be able to bring in a crowd big enough, you can rent the whole well space and collect 100% of the ticket sales.

The Well will set up a register for the band to use to take door sales on the night of the show. It is the Band's responsibility to have someone to take door sales. 

 

Keep in mind that The Well does not do any paid promotion. Promotion is solely the responsibility of the artist.

 

Please read through our terms of agreement before booking The Well.

This CONTRACT, entered into as of  Collected in Form Above  is for the personal services of THE MUSICIAN(S), identified below, of the performance described below. THE WELL, SOZO COFFEEHOUSE, GREAT ADVENTURE Ministries and THE MUSICIAN(S) agree to the contract as follows:

 

1. CONTACT INFORMATION (PHONE/EMAIL): Collected in the Form Above

2. NAME OF MUSICIAN(S)/BAND: Collected in the Form Above

3. NUMBER & NAMES OF MUSICIAN(S):  Collected in Form Above

4. NAME AND ADDRESS OF PLACE OF PERFORMANCE: The Well, 1314 Jones Street, Omaha, NE 68102

5. DATE OF PERFORMANCE: Collected in the Form Above

6. TIME OF PERFORMANCE:  Collected in the Form Above

 

7. GUARANTEED WAGE AGREED UPON: 

ARTISTS ARE SOLELY RESPONSIBLE FOR COLLECTING COVER CHARGE.

SOZO WILL NOT TAKE ANY COMPENSATION.

8. PAYMENT:

100% OF SALES WILL GO TO AND BE COLLECTED BY THE ARTISTS MENTIONED ABOVE.

 

9. PER THE NATURE OF THE VENUE, ALL MUSIC PERFORMED DURING THE SHOW MUST ABIDE BY THE FOLLOWING

CONDITIONS:

  • NO PROFANITY

  • NO DRUG REFERENCES

  • NO REFERENCES TO ILLEGAL ACTIVITY

  • NO SEXUAL CONTENT

THE WELL RESERVES THE RIGHT TO REMOVE SONGS THAT DO NOT CONFORM TO THESE CONDITIONS FROM THE SET LIST FOR THE NIGHT. BREACH OF THIS CONDITION MAY RESULT IN ANY OR ALL OF THE FOLLOWING PENALTIES:

  • LOSS OF 100% RENTAL PRICE

  • PREMATURE ENDING OF THE PERFORMANCE 

  • SUBSEQUENT BREACH OF CONTRACT AND ALL PENALTIES ASSOCIATED THEREIN

10. NOISE LEVELS:

  • DUE TO THE FAMILY FRIENDLY NATURE OF THE VENUE BEING CONDUCTED IN SOZO COFFEEHOUSE AND OUT OF RESPECT FOR OUR OTHER CUSTOMERS AND TENETS OF THE BUILDING, THE MAXIMUM DECIBEL LEVEL WILL NOT EXCEED 85 DECIBELS INSIDE THE WELL

    • ALL SOUND LEVELS WILL BE SUBJECT TO THE DISCRETION OF STAFF FROM EITHER THE WELL OR SOZO.

 

11. LOAD IN:

  • LOAD IN TIME WILL BE AN HOUR BEFORE THE FIRST MUSICIAN(S) SOUND CHECK.

  • THE WELL MANAGER OR A SOZO EMPLOYEE MUST BE PRESENT FOR LOAD IN AND SETUP, BUT ARE NOT GUARANTEED/REQUIRED TO HELP.

12. SOUND CHECK:

  • SOUND CHECK TIME WITH FULL ACCESS TO THE STAGE AND P.A. EQUIPMENT ON THE DATE OF THE PERFORMANCE SHALL BE AGREED TO ON THE ABOVE FORM.

 

13. DURATION OF PERFORMANCE:

  • AFTER A PERFORMANCE IS APPROVED AND PROPER STAFFING IS PROVIDED, THE PERFORMANCE MAY LAST AS LONG AS THE COFFEE SHOP/VENUE IS OPEN AND ALL EXPECTATIONS ARE KEPT.

    • A SUGGESTED FORTY-FIVE (45) MINUTES TO AN (1) HOUR FOR A PERFORMANCE BY EACH MUSICIAN(S).

  • TEARDOWN MUST TAKE PLACE PRIOR TO CLOSING TIME AT MIDNIGHT.

14. PROMOTION:

  • THE MUSICIAN(S) OR MANAGEMENT REPRESENTING THE MUSICIAN(S) SHALL BE PRIMARILY RESPONSIBLE FOR ALL MATTERS PERTAINING TO THE PROMOTION (AND ANY PRODUCTION DESIRED) OF THE SCHEDULED ENGAGEMENT, INCLUDING, BUT NOT LIMITED TO OUTSIDE ADVERTISING.

15. CANCELLATION:

  • IN THE EVENT THAT THE WELL CANCELS ANY PERFORMANCE LESS THAN (2) WEEKS BEFORE THE DATE OF PERFORMANCE, THE WELL WILL RESCHEDULE THE MUSICIAN(S).

  • IF THE PERFORMER CANCELS THE PERFORMANCE INSIDE (2) WEEKS, THERE IS A $25 FEE.

  • BOTH THE DUTY TO PERFORM FOR THE MUSICIAN(S) AND THE WELL IS SUBJECT TO DETENTION BY DEBILITATING SICKNESS, ACCIDENT, RIOT, STRIKES, EPIDEMIC, ACTS OF GOD OR OTHER LEGITIMATE CONDITIONS BEYOND THEIR CONTROL AS AGREED UPON AND LISTED ABOVE.

16. MERCHANDISING:

  • ARTIST(S) SHALL HAVE THE OPTION TO SELL ALBUMS, BOOKS, AND OTHER MERCHANDISE MATERIAL AND WILL RETAIN 100% OF THOSE SALES. 

  • THE WELL RESERVES THE RIGHT TO REMOVE ITEMS THAT MAY BE FOUND OFFENSIVE TO CUSTOMERS FROM THE ITEMS FOR SALE AT ANY TIME. 

17. DISPUTES:

  • IN THE EVENT ANY DISPUTE ARISES UNDER THIS CONTRACT THAT RESULTS IN LITIGATION OR ARBITRATION, THE PREVAILING PARTY SHALL BE PAID ITS REASONABLE ATTORNEY’S FEES AND COSTS BY THE LOSING PARTY.

18. DAMAGES:

  • THE WELL, SOZO COFFEEHOUSE, AND GREAT ADVENTURE MINISTRIES ARE NOT RESPONSIBLE FOR ANY HARM, LOSS, OR DAMAGE OF ANY KIND TO THE MUSICIAN(S) PERSON OR PROPERTY WHILE LOCATED AT THE PLACE OF PERFORMANCE (SECTION 4 HEREIN).

19. AMENITIES AVAILABLE TO THE MUSICIAN(S):

  • IF DESIRED, A GREEN ROOM SHALL BE PROVIDED AT NO CHARGE TO THE MUSICIAN(S) AND ANY SOUND TECHNICIANS ATTACHED TO THE MUSICIAN(S).

  • FREE PASSES WILL BE GIVEN TO ANY ARTIST AND SOUND TECH (IN THE EVENT THERE IS MORE THAN ONE PERFORMANCE DURING THE DATE).

20. SECURITY OF DATE:

  • RESERVATIONS ARE FIRST-COME FIRST-SERVE. THE FIRST COMPLETED/APPROVED CONTRACT HAS OWNERSHIP OF THE DATE.

  • ANY REQUESTS FOR THE SAME DATE/TIME WILL GO THROUGH THE WELL BOOKINGS MANAGER AND ORIGINAL PERFORMER(S).

 

This CONTRACT and any attachments or riders incorporated herein, shall be governed by the State of Nebraska law, and may be modified only by written and signed consent of both parties. This CONTRACT is binding and valid only when signed by both parties. The PAYMENT OF THE ABOVE FORM constitutes as signed consent to this contract. The WELL's confirmation of booking constitutes as its signed consent to this contract.

The persons signing for THE WELL, SOZO COFFEEHOUSE, and GREAT ADVENTURE MINISTRIES and THE MUSICIAN(S) agree to be personally, jointly, and severally liable for the terms of this contract.
